The CMSC and 84 Dreamers file litigation to pressure USCIS to approve their travel permits

The California-Mexico Studies Center, Inc. (CMSC) and 4 Dreamers filed a Petition for Writ of Mandamus and Complaint for Declaratory and Injunctive Relief on Monday April 26, 2021, in federal court on behalf of 84 DACA recipients whose applications to travel to Mexico (Advance Parole) have not been adjudicated despite being filed 8 months ago. 

The CMSC had to confront the reality that we cannot be patient or wait any more, and we have resorted to ‘making good trouble’ against the Biden/Harris administration in court.

Please read the following articles and the complaint that our attorneys filed in Los Angeles federal court, to force the U.S. Department of Homeland Security (DHS) and U.S. Citizenship and Immigration Services (USCIS) to respond to our plea for fairness and justice. 

The case was filed by veteran civil rights attorney Jorge Gonzalez and is formally known as California-Mexico Studies Center, Inc. Vs. U.S. Department of Homeland Security (DHS) and U.S. Citizenship and Immigration Services (USCIS), and names in their respective capacity, DHS Secretary Alejandro Mayorkas, USCIS Director Tracy Renaud and USCIS Chief of Staff Felicia Escobar Carrillo as defendants (Case No. 2:21-CV-03547). Read the full complaint here.

"Dreamers" sue the Government for permission to travel outside the country

A group of 84 "dreamers" (beneficiaries of the DACA program) presented a legal request to a Los Angeles court on Monday asking that the federal government be urged to respond to their requests for permission to travel outside the country.

Filed on behalf of these beneficiaries of the Deferred Action for Childhood Arrivals (DACA) in conjunction with the California-Mexico Studies Center (CMSC), the lawsuit asks a judge to order federal immigration officials to expedite their procedures for application to travel abroad for academic and family reasons.

"It is a legal action in which the judge to whom the case is assigned is asked to order government officials to perform a service for which they have been paid," Armando Vázquez-Ramos, president and executive director of CMSC, explained to EFE.

As explained by the activist and university professor, the Dreamers who filed the lawsuit have paid about $50,000 to obtain their permit known as Advance Parole and have submitted all the required documentation. Vázquez-Ramos recriminated that "since he took office, the government of (President Joe) Biden has ignored us."

Dreamers demandan al gobierno de Biden; exigen aprobación de Advance Parole

Este lunes, un grupo de 84 beneficiarios de DACA presentaron una demanda contra el gobierno de Joe Biden. En ella, exigen que USCIS apruebe sus solicitudes de Advance Parole para poder viajar a México a estudiar y conocer a sus familias. Estos dreamers presentaron sus solicitudes desde hace 8 meses.

Los beneficiarios de DACA presentaron su demanda frente a una corte en Los Ángeles. Al día siguiente, el martes 27 de abril, realizaron una conferencia de prensa frente a las oficinas de USCIS en dicha ciudad.

Durante esta conferencia estuvo presente Jorge González, el abogado de los 84 dreamers involucrados en la demanda. De acuerdo con González, los jóvenes aplicaron para el Advance Parole desde agosto de 2020... Leer Artículo Completo

Long-awaited trip to Mexico offers closure for one DACA recipient

COMPTON — The Deferred Action for Childhood Arrivals program, commonly referred to as DACA, gives limited protections to hundreds of thousands of immigrants brought into the U.S. as children.

DACA recipients must continually meet several stringent requirements or risk deportation. It makes seeing family outside the country for any reason very difficult, but it is possible.

One success story is Mayra Garibo who visited Mexico this year. It was her first time back since crossing the border with her mom and younger brother as a child. It’s been more than 20 years since Garibo felt the waters in Sinaloa, Mexico where she was born. “I waited so long for this,” said Garibo.

As a DACA recipient she couldn’t leave the country without special permission called advance parole. Her application was turned down several times despite her father’s sudden passing. Llaman a comunidad inmigrante a la marcha del Primero de Mayo (La Opinión)

Alrededor de 30 organizaciones comunitarias lanzaron un llamado a la comunidad migrante de Los Ángeles para que participen en la marcha del Primero de Mayo en Los Ángeles.

“Es imperativo que los migrantes se hagan presente porque vamos a demostrar nuestro apoyo a la histórica propuesta del presidente Biden de legalizar a los 11 millones de indocumentados del país”, dijo Francisco ‘Paco’ Moreno, director del Consejo De Federaciones Mexicanas (COFEM).
